The notary is a public official who has the institutional task of giving public faith to the deeds between private individuals and to the information contained therein. At the same time, he/she ensures the control of legality of the deeds and qualified legal assistance. The personal data provided by you or acquired in the context of our activity will be subject to processing based on the principles of correctness, lawfulness, transparency and protection of your/your privacy and your/your rights, in accordance with current legislation.
The processing of such personal data will be mainly aimed at fulfilling the obligations required by law in the context of the public notarial function. The processing may also be aimed at carrying out tasks assigned by the interested parties or to facilitate communication with them, where deemed useful or necessary.
The processing may be carried out on paper and also with the aid of electronic instruments, with methods suitable for guaranteeing the security and confidentiality of the data.
The provision of data is optional, however any refusal to provide us, in whole or in part, with your personal data or authorization for processing may result in the failure to perform the professional service.
The notary is required to communicate certain personal data to certain public entities; the data transmitted will mostly be used to update those same public registers from which it is possible that part of the data concerning you and any other interested parties has been taken. The data may also be communicated, exclusively for the purposes indicated above, to certain public or private entities, including banks, legal or tax consultants and other freelance professionals. They may also occasionally be entrusted to postal service providers, if deemed necessary for the purposes mentioned above. As provided for by Legislative Decree No. 231 of 16 November 2007, the data may also be communicated to the Financial Information Unit (UIF) in compliance with anti-money laundering regulations. Other parties may become aware of the data in their capacity as data controllers or processors. Under no circumstances will the personal data processed be disclosed.
Personal data classified as sensitive, i.e. data capable of revealing racial and ethnic origin, religious, philosophical or other beliefs in general, political opinions, membership of parties, trade unions, associations or organizations of a religious, philosophical, political or trade union nature, as well as personal data capable of revealing the state of health and sexual life, may also be subject to processing. This is to comply with a legal obligation or with the written consent of the interested party, subject to authorization by the Guarantor for the protection of personal data (article 26 of Legislative Decree no. 196/2003), according to the methods and for the purposes indicated above.

You may contact the data controller or the person responsible to assert your rights, as provided for by article 7 of Legislative Decree no. 196/2003, which is reported below for your convenience. It should be noted that the notarial deed, like any other similar document with public trust, is intended to be kept unchanged over time in its original content; any subsequent modification of the data contained therein must not and cannot entail a modification of the deed, but will be documented in its own manner. If notarial deeds require correction due to objective erroneousness of some of their elements, the correction can only be performed with a further notarial deed.
Art. 7 Right of access to personal data and other rights
1. The interested party has the right to obtain confirmation of the existence or otherwise of personal data concerning him/her, even if not yet registered, and their communication in an intelligible form.
2. The interested party has the right to obtain information on:
a) the origin of the personal data;
b) the purposes and methods of processing;
c) the logic applied in the event of processing carried out with the aid of electronic instruments;
d) the identification details of the owner, managers and designated representative pursuant to Article 5, paragraph 2;
e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, managers or persons in charge.
3. The interested party has the right to obtain:
a) the updating, rectification or, when interested, integration of the data;
b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which such fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected.
4. The interested party has the right to oppose, in whole or in part:
a) for legitimate reasons, the processing of personal data concerning him/her, even if pertinent to the purpose of the collection;
b) the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communications.
